Since 2006, Japan's Nichia, Toyoda Gosei, CREE, Philips Lumileds and Germany's Osram (OSRAM) five giants and South Korea's Samsung, LG, Taiwan's Jingdian, Yiguang Patent litigation between enterprises has continued, such as the patent litigation of Nichia and Everlight has not stopped since 2006. At the same time, they have formed a group advantage through patent authorization and cross-authorization, which has formed a higher threshold for subsequent entrants. In addition to the two surveys in February and August 2008, 337 investigations involved mainland enterprises, and other lawsuits did not involve mainland enterprises. With the rapid expansion of mainland production capacity and the increasing competitiveness of products, patent litigation against mainland enterprises has been launched. Although some domestic enterprises have acquired or invested in foreign or Taiwanese companies, they have not grasped several core basic patents. The patent protection of existing mainstream products is quite fragile. The PSS substrate patent and the two-step growth method patent are all very important basic patents in the current LED patent, and are in the international major factories such as Japan and Asia. At present, the amount of MOCVD in China has reached more than 40 in the world, but all GaN-based LEDs use a two-step growth method. All white LEDs are used in PSS substrates, that is, domestic LED chips have the risk of patent infringement.
The breakthrough of this technology will greatly promote the rapid and healthy development of the original innovative technology and industry of LED epitaxial chips in China, and it is very possible to rewrite the current competitive landscape of the international LED chip industry.
